Title: Assisting clients in vulnerable situations

Presentation Description: In September 2023 STEP Canada released its 2023 Client Service Resource: “A Guide to Assisting Persons in Vulnerable Circumstances.” The presentation will review highlights of the guide and how it can be used to assist professionals when serving their clients.

Speaker Bio: Kathleen Cunningham, BCom, LLB, MPS, TEP

Over her career, Kathleen served as Executive Director of the BC Law Institute (BCLI) and the Canadian Centre for Elder Law (CCEL) from 2015-2020, has led the delivery of education, legal support, and risk management at a major Canadian trust company, and assisted the Public Guardian and Trustee of BC with the implementation of personal planning and guardianship legislation, as well as projects addressing financial abuse of vulnerable adults. Kathleen was a member of two BC Law Institute Committees – Modernization of the Trustee Act, and Undue Influence Recognition and Prevention: A Guide for Legal Practitioners. She assisted STEP Canada with the planning, delivery, and final report for its 2021 Symposium on Vulnerable Clients and she is the author of STEP Canada’s 2023 Client Service Resource: “A Guide to Assisting Persons in Vulnerable Circumstances.” Kathleen served on STEP Worldwide Council (2015-2017) and in December 2023 she completed a six-year term on the steering committee for the STEP Worldwide Mental Capacity Special Interest Group.

    As a trained legal professional from Europe, Lilian upgraded his legal education at SFU with a Master in Applied Legal studies to become a BC Notary Public. He is an award-winning entrepreneur, Notary Public, and educator, with offices in Langley and Aldergrove. With over 15+ years of estate planning experience, he provides trusted guidance on wills, powers of attorney, representation agreements, and real estate transactions. Known for his clarity, professionalism, and client-centered approach, Lilian works closely with individuals, families, and professionals to ensure thoughtful, customized, and legally sound planning.

    Suzannah’s Bio: 

    Suzannah Denholm is a litigation lawyer and a long-time resident of Surrey. She completed her undergraduate degree at Carleton University School of Journalism, and her law degree at the University of Ottawa. She was called to the Ontario Bar in 1999 and the British Columbia Bar in 2001.

    Suzannah is a litigator with particular experience in resolving personal law claims, either in court or otherwise. She began working at Hamilton Duncan in 2015 after working at large firms in Ottawa and in downtown Vancouver where she appeared at all levels of Canadian courts, including the Supreme Court of Canada.

    Presentation Description:

    As legal and financial professionals, we are entrusted with documenting and safeguarding our clients’ intentions. Since much of the case law centers on interpreting and upholding those intentions, this presentation will highlight common issues that arise from faulty planning and the lessons we can learn from them. Drawing on both estate planning and litigation perspectives, we will explore practical strategies to ensure our clients’ wishes are protected and preserved.
